JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-04-2021 Heard Mr. Abhishek Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 249 of 2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. On secret informant that a truck loaded with liquor is stuck-up in mud, a raid was conducted. From near the vehicle in question, the petitioner and some others fled away. Patna High Court CR. MISC. No.36909 of 2020(2) dt.08-04-2021 2/2 submitted that his implication in this case is only on the basis of suspicion. Though the petitioner has been named in the F.I.R., but he has got no concern either with the vehicle in question or the items which are said to have been recovered from such vehicle.

The petitioner has clean antecedents.

Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 13th Addl. Sessions Judge-CumSpecial Judge, Excise, Motihari, East Champaran in connection with Excise Case No. 249 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
