JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-01-2015 Heard learned counsel for the parties.

The petitioner, who is a declared juvenile, is an accused in a case under Sections 147, 148, 302/149 of the Indian Penal Code.

The informant alleged that on instigation of Arjun Yadav, petitioner along with six other persons brought pistols and fired upon his father, which caused the death of his father. Learned counsel for the petitioner submits that the deceased sustained only three injuries whereas the allegation of firing is against seven persons. He further submits that the petitioner has been implicated in this case, as the prosecution side has enmity with his relatives. He further submits the petitioner was earlier assaulted on account of which his leg was amputated and a

In the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class-cumMember Juvenile Justice Board, Nawada in connection with G.R. No. 2430 of 2012 (J.T.R. No. 297 of 2014), arising out of Nardiganj P.S. case No. 100 of 2012 with the condition that the father of the petitioner would file an affidavit in the court below to take care of his son.
