The petitioner apprehends his arrest in Desari P.S. case No. 227 of 2018 registered under Section 379, 414/34 of the IPC.
The informant intercepted a motor cycle and apprehended Vikash Kuamr with the motor cycle. Vikash Kumar disclosed that he stole the motor cycle with the help of Abhishek Kumar, Gautam Kumar, Sanjeev Kuamr and Ajay Sahni @ Kanha, the petitioner.
The learned counsel for the petitioner submits that petitioner has got no criminal antecedent. Vikash Kumar was apprehended with stolen motor cycle and save and except disclosure made by Vikash Kumar there is no material on record to show that petitioner stole the motor cycle with Vikash Kumar.

No.37002 of 2019(2) dt.17-06-2019 2/2 Taking into consideration the facts that name of the petitioner figured in the case on the basis of disclosure made by Vikash Kumar from whose possession stolen motor cycle was recovered and the petitioner has got no criminal antecedent, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari P.S. case No. 227 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
