JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 342, 384/34 of the Indian Penal Code. It is alleged by the informant that he police personnel on duty apprehended vehicle and demanded Rs. 5,000/- and he vehicle was not allowed for long three hours. Ultimately he was made to rescue out of Rs. 5,000/- and he was further manhandled and insulted also.
It has been submitted on behalf of the petitioner that no specific allegation has been made against the petitioner. It is further submitted that the petitioner is on the post of Home Guard, who was working under his Superior Officer at the time of occurrence. It is also submitted that the petitioner has got no

On behalf of the State, it has been submitted that the petitioner is not named in the FIR.
Considering the aforesaid fact that the petitioner was working under his Superior Officer at the time of occurrence, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kishanganj, in connection with Bahadurganj P.S.Case No. 22 of 2015 (G.R.No. 130 of 2015), subject to the conditions as laid down u/s 438(2) Cr.P.C.
