The petitioner is apprehending arrest in a case registered for the offences punishable under Sections of the Indian Penal Code.

It is alleged that the petitioner and others demanded liquor from the liquor shop of the informant when it was not supplied then accused persons including the petitioner put the liquor shop of the informant on fire.

It is submitted by learned counsel for the petitioner that during investigation the accusation of putting the liquor shop in fire has been found false. Subsequently, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on

Patna High Court Cr.Misc. No.35200 of 2015 (2) dt.21-08-2015 2/2 record as annexure- 3 to the petition. At earlier point of time, the wife of brother of the petitioner has lodged Paliganj P.S. Case No.289 of 2013 against the informant. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Paliganj P.S. Case No.290 of 2013, pending before the learned Chief Judicial Magistrate, Patna.

With the above observation, this application is, accordingly, disposed off.
