02. 08.07.2015 Heard learned counsel for the Petitioner and the State.

The Petitioner is apprehending his arrest in Bihta P.S. Case No. 611 of 2013 registered under Sections 341, 323, and 504 of the Indian Penal Code and Section 3(i)(x) of SC/ST Act pending before the Additional Chief Judicial Magistrate, Danapur, Patna.

The Petitioner was granted anticipatory bail by this Court by order dated 23.06.2014 on condition that an affidavit would be filed on his behalf that he has fair antecedents. Since the Petitioner had criminal antecedents such an affidavit could not be filed and he could not get benefit of the order.

Considering that this is a second application for anticipatory bail which is not maintainable, the application is

Patna High Court Cr.Misc. No.144 of 2015 (2) dt.08-07-2015 disposed off with direction to the Petitioner to surrender before the Court below within six weeks from the date of receipt of this order which shall pass necessary orders considering the facts that on merit the Petitioner was found fit to be released on anticipatory bail.

With the aforesaid observations, the application is disposed off.
