The petitioner, who is in custody, seeks bail in connection with Mehsi P.S. Case No. 82 of 2016 registered for offence under Section 379 of the Indian Penal Code. Allegation in brief is that the informant while attending the call of nature by parking his tractor, it is stated that it was taken away by some accused persons and one Bolero also followed that tractor.
Learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in this case except confessional statement of co-accused Rahul Kumar who disclosed the name of this petitioner as an accomplice, there is no
Patna High Court Cr.Misc. No.611 of 2017 (2) dt.11-01-2017 material against him. Nothing has been recovered from the possession of this petitioner nor he was put on T.I. Parade. In this case charge sheet has also been submitted.
Considering the aforementioned facts and circumstances of the case and in particular no material except the disclosure of name of the petitioner by the co-accused in his confessional statement so the petitioner Chandra Ketu Kumar, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VI, East Champaran at Motihari in connection with Mehsi P.S. Case No. 82 of 2016.
