JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 Heard learned counsels for the petitioners and the State. The petitioners being the uncle and aunt of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after three years of the marriage for non-fulfilment of the dowry demand.

It is submitted by learned counsel for the petitioners that though petitioner no.2 has been described as mother-in-law in the FIR but in fact petitioner no.2 is the aunt of the husband of the victim. The informant himself admitted that the marriage of the

No.25760 of 2015 (2) dt.14-07-2015 2/2 sister of the husband of the victim was fixed for 14.05.2015 hence it appears unreasonable that accused can think of committing such heinous offence on 26.04.2015. pThe petitioners claimed to be separate from the husband of the victim.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Sadar P.S. Case No. 212 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
