The petitioner seeks bail in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

63 liters of Nepali liquor is said to have been recovered from the three gunny bags and petitioner was apprehended, while three other accused persons carrying the said bags managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the

He has been falsely implicated in this case by the police merely on suspicion while he was passing through the place of occurrence at the time of occurrence while the actual culprit managed to escape dumping the aforesaid article there. He has no concern with the seized liquor. He has no criminal antecedent and has been languishing in custody since 27.03.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 4th-cum-Special Judge Excise, East Champaran at Motihari in connection with Excise Case No.148 of 2018.
