Petitioner seeks bail in a case registered for the offences punishable under Sections 399/402 of the Indian Penal Code read with Sections 3,4 and 5 of Explosive Substance Act. When the petitioner was apprehended alongwith others by the police on suspicion that they were preparing to commit dacoity, nothing was recovered from possession of the petitioner. Only material against the petitioner is his criminal antecedent. Petitioner is in custody since 06.03.2019.

Considering the facts of this case, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Twenty

Patna High Court CR. MISC. No.39018 of 2019(2) dt.26-06-2019 2/2 Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chandauti Police Station Case No.34 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
