The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code which was later on converted as under sections 395 and 412 of the Indian Penal Code. As per the prosecution case, four unknown accused persons variously armed are said to have entered the house of the informant and of having stolen Rs.40,000/- in cash, 800 grams of silver, 110 grams of gold ornaments etc. It is submitted by learned counsel for the petitioner that the F.I.R was registered against four unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Sulendra Paswan who has

Patna High Court CR. MISC. No.40446 of 2022(3) dt.20-01-2023 2/2 himself been enlarged on bail vide order dated 8.8.2022 passed in Cr. Misc. no. 20965 of 2022. Besides other co-accused have also been enlarged on bail vide different orders brought on record as Annexure-2 series to this petition. The petitioner is in custody since 23.5.2022 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, grant of bail to co-accused Sulendra Paswan on whose confessional statement before the police the name of the petitioner transpired, the petitioner being in custody for over 7 months since 23.5.2022 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Mansi P.S. Case no. 205 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
