JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Complaint Case No.- C.A. 637 of 2014 for the offence under Sections 323, 504, 376 of the Indian Penal Code. Heard learned counsel for the petitioner, learned counsel for the complainant and the State.
The prosecution story, in brief, is that the petitioner Mangal Rai committed rape upon the complainant and later on rest petitioners Kailu Rai and Uchit Rai arrived there and slapped and took away the petitioner no. 1. It is submitted on behalf of the petitioner that the petitioner has been falsely implicated in the present case and the present case was instituted with an intention to blackmail the petitioner. In the present case the notices were issued to the complainant.

No.1358 of 2015 (3) dt.08-05-2015 Learned counsel for the complainant appearing in the Court submits that the victim has already been married to the petitioner and she is residing with the petitioner. Hence in the said circumstances, he does not want to pursue the matter any further.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Katihar in connection with Complaint Case No. -C.A. 637 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
