The petitioners seek bail in Dalsingsarai P.S. Case No. 348/2016, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The informant alleged that his daughter married with petitioner no. 1 Md. Sabool ten years ago. Md. Sabool also solemnized second marriage with Kuraisha Khatoon. It is further alleged that Kuraisha Khatoon and her son killed the daughter of the informant.

It has been submitted that petitioners are not named in the F.I.R. Their complicity in the said crime has not been found during investigation. Petitioner no. 1 is the husband of the

Patna High Court Cr.Misc. No.26870 of 2018 (5) dt.11-09-2018 2/2 deceased. Petitioner no. 2 is the daughter of second wife of petitioner no. 1 and petitioner no. 3 is mother-in-law of petitioner no. 2, who are living separately and have no concern with the family affairs of the deceased.

The petitioners have no criminal antecedent. They are in custody since 19.09.2017.

Considering the facts aforesaid, the petitioners abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Ist, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S. Case No. 348/2016.
