The petitioner seeks bail in a case instituted for the offence under Sections 399, 402 and 414 of Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. It has been submitted that police filed written report alleging that petitioner and other accused persons were making preparation for dacoity. It has further been submitted that petitioner was apprehended on the spot and one mobile phone of Samsung has been recovered from his possession. It has further been submitted that other co-accused has been granted regular bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 52815 of 2016 dated 19.12.2016.
Patna High Court Cr.Misc. No.5684 of 2017 (2) dt.23-02-2017 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Thawe P.S. Case No. 121 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner.
