The petitioner is apprehending arrest in a case registered for the offences punishable under Section 302 of the Indian Penal Code 27 of the Arms Act.
On murder of brother of the informant, the FIR was registered against unknown. The name of the petitioner sprang up during investigation on confession of co-accused Shambhu Tanti from whom recovery has also been made.
It is submitted by learned counsel for the petitioner that except the confession of the co-accused, there is nothing against the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.32452 of 2015 (2) dt.10-08-2015 2/2 consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Kahalgaon (Shivnarayanpur) P.S. Case No.6 of 2014, pending before the learned Chief Judicial Magistrate, Bhagalpur. With the above observation, this application is, accordingly, disposed off.
