JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Muffasil P.S.Case No. 80 of 2021 for the offences punishable under Sections 30(a), 41 (i) of the Bihar Prohibition and Excise Act 2018.

As per allegation in the F.I.R 1298.985 liters country made liquor was recovered from Scorpio and Pick-up-van. Learned counsel for the petitioner submits that petitioner is falsely implicated in this case due to ulterior motive. Nothing has been recovered from their possession. Learned Additional Public Prosecutor opposed the

Patna High Court CR. MISC. No.49179 of 2021(2) dt.04-03-2022 2/2 bail prayer of the petitioner and submitted that petitioner no. 1 has six criminal antecedent and petitioner no. 2 has three criminal antecedent, which is mentioned in Para-3 of the petition.

Considering the facts, I am not inclined to enlarge the petitioner on anticipatory bail and hence, his prayer for anticipatory bail stands rejected.

Petitioners are directed to surrender before the court below and seek regular bail.
