JUSTICE SANJAY PRIYA ORAL ORDER 20-06-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Koransarai P.S. Case No. 34 of 2019, instituted for the offence under Section(s) 379, 411, 413 and 414/34 of the Indian Penal Code.

Counsel for the petitioner submits that name of this petitioner has been disclosed by co-accused Santosh Kumar who has been apprehended by the Police.

It is alleged in the written report that informant on getting confidential information that at Middle school two persons were trying to sell Motorcycle, he along with other Police party reached the place of occurrence. On seeing the Police Party two persons were trying to run away, but they were apprehended. They disclosed their names as Santosh Kumar and Ritesh Kumar. They also disclosed before the Police that they used to sell the Motorcycle at the instance of one Raj Kumar Yadav @ Dhanjee Yadav. It is

No.37336 of 2019(2) dt.20-06-2019 2/2 further alleged that Santosh Kumar confessed before the Police that Ranjan Yadav and Lalu Yadav (petitioner) get Rs.2000-3000 as commission on selling the stolen Motorcycles. The informant on getting such information raided Mathila Kali Mandir from where six persons including petitioner riding on three Motorcycles were apprehended.

In this manner, there is no allegation of any specific overt act against the petitioner. The name of petitioner has been disclosed by other co-accused persons.

It is mentioned in paragraph-3 of the bail petition that petitioner has clean antecedent.

Petitioner is in custody since 20.4.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Court No. 1, Buxar, in connection with Koransarai P.S. Case No. 34 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
