2. Petitioner apprehends arrest in a case registered for the offence punishable under section 108, 115(2), 126(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

The prosecution case, in brief, as per the written application of the informant, Ranjoo Devi, is that on 19.04.2025 at about 08:30 P.M., upon returning to her house from Patna, she found that the accused persons, namely, Sanju Paswan, Chando Devi, Ajit Paswan, and Chandan Kumar, were assaulting her 14year-old daughter, Anshu Kumari, and making false allegations regarding her character. When the informant intervened to
Patna High Court CR. MISC. No.39587 of 2026(2) dt.23-06-2026 2/3 rescue her daughter, the accused persons also assaulted her. Being terrified by the incident, Anshu Kumari ran into a room and locked herself inside; however, it is alleged that petitioner, Sanju Paswan thereafter locked the room from outside. Due to the fear, humiliation, and mental distress caused by the conduct of the accused persons, Anshu Kumari allegedly committed suicide by hanging herself inside the room. Subsequently, the occurrence was reported to the police by the informant's husband, Yoginder Paswan, whereupon the present FIR was instituted against the accused persons for appropriate legal action .

On perusal of record, it appears that it appears that the petitioners are specifically named in the FIR with the allegation that they were assaulting the deceased, Anshu Kumari, and making false imputations regarding her character, which caused her severe mental trauma and compelled her to confine herself inside a room. It is further alleged that thereafter petitioner No. 1 Sanju Paswan locked the room from outside, as a result of which the deceased, being overwhelmed by fear, humiliation, and distress, committed suicide by hanging herself. The statements of the witnesses recorded during investigation, particularly those contained in paragraphs 4, 9, 10, and 11 of the
Patna High Court CR. MISC. No.39587 of 2026(2) dt.23-06-2026 3/3 case diary, also support the prosecution version . 5 . Considering the aforesaid facts and circumstances of the case, the nature and gravity of the allegations, and the materials collected during investigation, this Court does not find it a fit case for grant of bail to the petitioners at this stage and as suchy, the prayer for bail of these petitioners is rejected.
