JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 447/341/323/504/506/427/379/448/384/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that for not repairing the mobile of the coaccused Rajesh Sao, the informant was assaulted and abused by calling caste name. The accused persons took away mobile from the shop of the informant worth Rs.20,000/- and demanded extortion of Rs.10,000/- per month.
It is submitted by learned counsel for the petitioner that accusation is omnibus and general and for the occurrence of
Patna High Court Cr.Misc. No.25824 of 2015 (2) dt.17-07-2015 2/2 16.04.2015, the FIR was registered on 18.04.2015. Earlier coaccused Rajesh Sah was assaulted at the hands of the informant but the police called the informant and got the issue settled, as a result, the case of the accused persons could not be registered but, subsequently, the informant got his case registered. Considering the delayed lodging of the case and accusation being omnibus and general, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Biharsharif SC/ST P.S. Case No.40 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
