JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 201, 120B of the Indian Penal Code and Section 7 of The Essential Commodities Act.

Raid was laid in the premises of M/s Durga Fertilizer Agency, Noorsarai on 30.01.2015 when the fertilizers were sealed and Noorsarai P.S. Case No. 26 of 2015 was registered, subsequently when the seal was opened it was found that sealed fertilizers were missing.

It is submitted by learned counsel for the petitioner that the petitioner is the son of proprietor of the alleged firm. Moreover, seized articles were sealed and it was in the possession of sealing authority. A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.25854 of 2015 (2) dt.20-07-2015 2/2 petition that the petitioner has no criminal antecedent. Considering the suspicious nature of accusation and the fact that petitioner is not the proprietor, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Noorsarai P.S.
