JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 294 of 2007 registered for the offences punishable under Sections 409, 467, 420, 468 and 120B of the Indian Penal Code.
Petitioner was appointed an agent to execute the government scheme and accordingly, he took some advance but he did not submit vouchers and other documents.
Learned counsel for the petitioner drew my attention towards Annexure-2 to this petition and submitted that advance given to the petitioner has already been adjusted and having similar allegation some co-accused have already been granted privilege of anticipatory bail by different benches of this court.
Patna High Court Cr.Misc. No.2426 of 2015 (2) dt.20-01-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Bakhtiyarpur P.S. Case No. 294 of 2007 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
