Petitioner apprehends his arrest in connection with Bihra P. S. case no. 120/2014 registered under section 395 of the Indian Penal Code.

Petitioner is not named in the first information report but his name surfaced in course of investigation in confessional statement of co-accused.

Investigation against the petitioner is still pending. Therefore, it is not fit case for anticipatory bail and accordingly, his prayer for anticipatory bail in connection with the above stated case stands rejected.

However, if petitioner surrenders within six weeks

Patna High Court Cr.Misc. No.25906 of 2015 (2) dt.27-07-2015 from today and seeks regular bail, his regular bail application shall be considered on its own merit without being prejudiced by this rejection order.
