26-11-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Siwaipatti P.S. Case No. 11 of 2011 / Tr. No. 730 of 2018, registered for the offence under Sections 147, 149, 435, 427 & 379 of the Indian Penal Code and Section 17 of C.L.A. Act.

Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation on the basis of confessional statement of co-accused Harendra Ram, who has already been granted bail by this Court, vide order dated 16.11.2011 passed in Cr.Misc. No. 37050 of 2011. Till date, petitioner has not been put on T.I.P. Similarly situated coaccused persons namely Munna Prasad and Sanjay Thakur @ Sushil have also been granted bail by this Court, vide order

Patna High Court CR. MISC. No.50623 of 2021(2) dt.26-11-2021 2/2 dated 16.02.2012 passed in Cr.Misc. No. 4602 of 2012 and order dated 14.08.2012 passed in Cr.Misc. No. 27216 of 2012 respectively. Petitioner is in custody since 23.09.2019. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Muzaffarpur in connection with Siwaipatti P.S. Case No. 11 of 2011 / Tr. No. 730 of 2018.
