JUSTICE SUDHIR SINGH ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in Karai Parsurai P.S.Case No. 74 of 2014 instituted under Sections 364(A)/34 of the Indian Penal Code, pending in the Court of Shri Rashmi Prasad, Judicial Magistrate, 1st Class, Hilsa, DistrictNalanda. The prosecution story, in brief, is that the4 informant Sukhu Paswan has alleged that his son Laxman Kumar aged about 14 years has been kidnapped by the accused persons including the petitioner after making conspiracy.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has been made accused in the present due to dirty village politics. It is

On behalf of the State, it has been submitted that the victim is a minor boy and is still traceless. It is also submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner and same is rejected. Any how, if the petitioner surrenders in the court below and pray for regular bail, same shall be considered on its own merit without being prejudiced by this order of rejection.
