Petitioner seeks bail in a case registered under sections 395 and 397 of the Indian Penal Code.

Earlier prayer for bail of the petitioner was rejected by this court vide order dated 19.2.2016 passed in Cr. Misc. no. 937/2016 but the trial court has reported that charge against the petitioner has already been framed and case is pending for disposal. Trial court has mentioned in his report that trial of the petitioner may be concluded within six months.

Learned counsel for the petitioner submits that the petitioner does not have any criminal antecedent and, as a matter of fact, he was not aware of this fact that seized sheep is stolen property. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.45870 of 2016 (3) dt.30-11-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge II, Kaimur at Bhabua in Sessions Trial no. 99/2016 arising out of Durgawati P.S. Case no. 193/2015 subject to condition that one of the sureties must be local and holder of the landed property.
