The petitioner has renewed his prayer for bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 108 litres of liquor was recovered from the vehicle being driven by the petitioner. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 4.3.2022 (Annexure-1) giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody for more than one year since 1.7.2021.

Heard learned A.P.P. for the State.

No.40531 of 2022(2) dt.03-08-2022 2/2 Having heard learned counsel for the parties and taking into consideration the nature of allegation, the liberty granted by the aforesaid order of rejection dated 4.3.2022 and the petitioner having remained in custody for more than 1 year since 1.7.2021, the Court directs the petitioner to be enlarged on bail in connection with Bathnaha P.S. Case no.163 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Exclusive Special Excise Court no.1, Sitamarhi.
