====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 302, 120B and 201 of the Indian Penal Code.
Allegation against the petitioners is that they executed lands of the husband of the informant on different dates in favour of them without paying any consideration money and lastly they committed murder of her husband.
It has been submitted on behalf of the petitioners that they have got no criminal antecedent. There is no eye witness to the alleged occurrence. Merely on suspicion petitioners have been named in the present case. There is no circumstantial evidence also to suggest participation of the petitioner in the alleged occurrence.
On behalf of the State, it is submitted that merely on presumption petitioners are named in the F.I.R.

No.27311 of 2015 (3) dt.28-09-2015 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Sasaram, Rohtas in connection with Kargahar P.S. Case no. 94 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
