JUSTICE BIRENDRA KUMAR ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The daughter of the informant committed suicide by hanging herself. The petitioner is husband of the victim. There is no allegation of any demand and torture for the same. Submission of the petitioner is that no offence under Section 304B of the Indian Penal Code is made out and there is no eyewitness of the occurrence.

Considering the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.55251 of 2016 (3) dt.13-02-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Araria/Successor Court, in connection with Palasi P.S. Case No. 144 of 2016.
