The petitioners, who are in custody, seek bail in connection with Piar P.S.Case No. 54 of 2016 (G.R. No. 3621 of 2016) registered under Sections 376/34 of the Indian penal Code. Allegation in brief is that the prosecutrix was raped by three persons at about 4:00 P.M. in the banana orchard and it is also alleged that while she was being raped, some photographs were being taken by other accused.

It is submitted that the prosecutrix is a married lady and she has lodged this case after lapse of more than a month and the petitioners have been falsely implicated in this case due to village politics and even she was not ready for medical

Patna High Court Cr.Misc. No.5600 of 2017 (3) dt.08-03-2017 2/2 examination and refused for the same and no photograph has been recovered by the police from the petitioners and they are in custody since 06.09.2016.

Having considered the aforesaid facts and circumstances, the petitioners, namely, Mantun Rai and Mukesh Das, are directed to be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Sub Judge-V-cum-A.C.J.M., Muzaffarpur in connection with Piar P.S.Case No. 54 of 2016.
