The petitioners seek bail in Minapur P.S. case No. 19/2020 registered u/s 30(a), 38(1),41 of the Bihar Prohibition & Excise Act.

The informant got secret information and raided some huts situated on the other side of the river but the accused persons managed to flee away. It is alleged that from the hut of the petitioners 388.80 liters of liquor was recovered. The learned counsel for the petitioners submits that petitioners are not the owner of the hut. Nothing has been recovered from the possession of the petitioners and the petitioners have no manner of concern with liquor kept in the

Patna High Court CR. MISC. No.36717 of 2020(2) dt.01-02-2021 2/2 hut situated in a lonely place. The petitioner No.2 has got no criminal antecedent and petitioner No.1 is accused in a case of similar nature but the petitioners are in custody since 27.08.2020.

Taking into consideration the facts aforesaid and the fact that petitioners have remained in jail for more than five months, the petitioners, above named, are directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Minapur P.S. case No. 19/2020.
