The petitioners apprehend their arrest in connection with Udakishunganj P.S. Case No.395 of 2020, registered for the offences punishable under Sections 363, 365 and 120(B) of the Indian Penal Code.

The petitioners and other co-accused persons are said to have kidnapped the father of the informant. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. There is no eye witness of the occurrence and only on suspicion, the petitioners have been made accused in the

Patna High Court CR. MISC. No.49671 of 2021(3) dt.05-07-2022 2/2 present case. The allegation against the petitioners is that the petitioners used to accuse the father of the informant of giving sickness by doing witchcraft. It is lastly submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Taking into consideration the fact that there is no specific overt act against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Udakishunganj, District Madhepura in connection with Udakishunganj P.S. Case No.395 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J.) Sanjay/- U T
