The petitioner seeks bail in Muffasil P.S. Case No. 202/2016, registered for the offences punishable under Sections 457, 380 and 411 of the Indian Penal Code.

The informant alleged that she got information that theft was committed in her house and she came to know that Mangal Sahani @ Santosh Sahani (petitioner) took the articles from her house. Sarpanch of the panchayat recovered some stolen articles from the house of the petitioner.

Learned counsel for the petitioner submits that the informant did not disclose the names of articles stolen from her house. No mark of identification was disclosed. T.V. etc. were

Patna High Court Cr.Misc. No.54502 of 2016 (2) dt.12-01-2017 recovered from the house of the petitioner. Petitioner has got no criminal antecedent and he is in jail since 01.09.2016. Petitioner has already remained in jail for more than four months. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Samastipur in connection with Muffasil P.S. Case No. 202/2016.
