The petitioner is in custody in connection with Baragniya P.S. Case No. 160 of 2015, G.R. No. 3069 of 2015 for the offenses under Sections 409/ 467/ 468/ 471/ 120B of Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Allegation against the petitioner is that on the basis of forged documents, he got appointed as Teacher. During the verification of the certificates of the 27 teachers, certificates were found fake including the certificate of the petitioner and, thereafter, the petitioner resigned the job. He further submits that the petitioner is prepared to refund the amount which he received as salary

Patna High Court CR. MISC. No.40311 of 2019(2) dt.01-07-2019 2/2 working as Teacher. The petitioner is in custody since 24.03.2019.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner, subject to the condition that the petitioner shall return the amount received as salary within a period of six months. Let the petitioner, above named, be enlarged provisionally on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Baragniya P.S. Case No. 160 of 2015, G.R. No. 3069 of 2015.

The provisional bail shall be made absolute by the Court below on payment of the amount received by the petitioner on the basis of appointment as Teacher on forged certificates.
