Petitioners apprehend their arrest in Salimpur P.S. Case No.147 of 2019 registered under Sections 147, 148, 149, 341, 342, 323, 332, 333, 336, 379, 353, 427, 504 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners have committed no offence and have falsely been implicated in this case.
It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by different benches of this Court vide order
Patna High Court CR. MISC. No.49517 of 2021(2) dt.29-03-2022 2/2 dated 18.11.2019 and 20.11.2019 passed in Cr.Misc.No.70445 of 2019 and Cr.Misc.No.73853 of 2019 respectively (Annexure P3 series). He also submits that the case of the petitioners stands on better footing as that of other accused persons. The petitioners have got no criminal antecedent.
Having considered the above facts and circumstances of the case, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing personal bonds to the satisfaction of learned Judicial Magistrate, 1st Class, Barh, Patna in connection with Salimpur P.S. Case No.147 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. Harish/- (Arvind Srivastava, J) U T
