JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise Act, 2016. 55 bottles, each containing 300 milliliters Nepali Saufi liquor are said to have been recovered from the possession of petitioner, for which, the petitioner is languishing in custody since 29.07.2016. The petitioner does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as detention period of the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten
Patna High Court Cr.Misc. No.42908 of 2016 (3) dt.06-10-2016 2/2 Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sikarahna at Dhaka, East Champaran, in connection with Chiraiya P.S. Case No. 138 of 2016.
