ANJANA MISHRA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Auria P.S.Case No. 148 of 2014 registered under Sections 147, 148, 323, 324, 307, 452, 379 and 504 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner and the informant side are both agnates and they have been on litigating term and the petitioner also filed counter case which has been registered as Aurai P.S.Case No. 196 of 2014. He further submits that the injuries purported to have been inflicted are simple in nature.
Considering the aforementioned facts and circumstances
Patna High Court Cr.Misc. No.30024 of 2015 (3) dt.14-10-2015 and that the parties are agnates having litigation and that the injuries are simple in nature, let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Aurai P.S.Case No. 148 of 2014 to the satisfaction of Sri Jawed Alam, Judicial Magistrate, 1st Class, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
