JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in G.O. Case No.17 of 2016 instituted for the offence under Sections 20(b) of the Narcotic Drugs & Psychotropic Substances Act.

It is alleged that 225 grams of Ganja has been recovered from the counter of watch shop of the petitioner. It is mentioned in the prosecution report itself that accused was not present at the time of seizure of the alleged Ganja. It has been submitted on behalf of the petitioner that petitioner was not found in conscious possession of the aforesaid seized Ganja. The petitioner is a man of clean antecedent. He has falsely been implicated in this case.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Darbhanga, in connection with G.O. Case No. 17 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
