JUSTICE ARUN KUMAR ORAL ORDER 16-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.03.2018, seeks bail in Muzaffarpur Sadar PS Case No. 17 of 2018 registered under Sections 394,302 of the IPC.

Learned Counsel for the petitioner submits that the FIR is against unknown. The informant has stated that he had taken photograph of only one person who was later on identified as Raja but no photograph of the petitioner was taken by the informant; he was not put on TIP for identification purpose, only his photograph is said to have been identified so the petitioner was made accused only on the basis of confessional statement of one Raja, another coaccused, but no incriminating material has been recovered from his possession and he has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Ashif Sohrab @ Ashish Sohrab is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar PS Case No. 17 of 2018.
