Petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of the minor daughter of the informant. The victim in her statement under Section 164 Cr.P.C. has levelled allegation of kidnapping against the petitioner and others. However, she has not alleged any other offence committed by any of the accused. Petitioner is in custody since 23.11.2017. Investigation of the case is already complete.

Submission is that on failure of marriage negotiation, just to pressurize false case has been lodged.

No.12267 of 2018 (4) dt.30-04-2018 2/2 Considering the aforesaid facts and materials, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with POCSO Case No. 01 of 2018 arising out of Madhepura (Parmanandpur O.P.) Police Station Case No. 591 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
