The instant application has been preferred by the petitioner for grant of regular bail in a case registered under section 302 and 34 of the Indian Penal Code and section 27 of the Arms Act.

By order dated 6.4.2021, a report with respect to the stage of trial had been called for from the learned court below. As per the report received contained in letter dated 22.4.2021, out of the 6 witnesses, 5 witnesses have been examined, crossexamined and discharged. Only the Investigating Officer of the case remains to be examined.

In view of the contents of the report and the trial

Patna High Court CR. MISC. No.32866 of 2020(7) dt.02-08-2021 2/2 having proceeded, learned counsel for the petitioner submits that for the moment, he is not pressing this application on merit. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, especially the report with respect to stage of trial received from the learned court below, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Learned trial court is directed to expeditiously conclude the trial within six months.
