Petitioner seeks bail in a case registered for the offences punishable under Sections 20(b)(ii)A of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Perused the report of the Superintendent of Police, Bhojpur, Ara.

When the police chased, the back rider of a motorcycle fell down and from his possession 25 Kg. of Ganja was recovered. That person disclosed to the police that this petitioner was driver on the motorcycle and had fled away. Submission is that the petitioner is in custody since 01.08.2017 after remand from some other case. Except

Patna High Court Cr.Misc. No.13511 of 2018 (4) dt.30-04-2018 2/2 confessional statement of co-accused, namely, Bhikari Singh before the police, there is no other material against the petitioner. Investigation of the case is already complete. Considering the aforesaid material, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with N.D.P.S. Case No. 18 of 2017 arising out of Ara Town Police Station Case No. 296 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
