1. Heard learned counsel for the petitioner and learned A.P.P. for the State Mr. Chandra Bhushan Prasad.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 354B, 379 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 29.03.2024 at around 9.30 A.M., informant and her husband were attacked by the accused persons including the petitioner, when they were harvesting their crop, it is further alleged that petitioner slammed the informant and torn her clothes while Chintu fired upon her husband, who sustained
Patna High Court CR. MISC. No.44810 of 2024(4) dt.28-01-2025 2/3 firearm injury in his abdomen. It is further alleged that the accused persons looted her house hold articles. It is also alleged that the reason behind the occurrence is previous dispute between the parties, in which, brother of Chintu died.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant for the reason that Vimal, brother of Chintu was killed, for which, Bhabua P.S. Case No. 1028 of 2023 was instituted, in which the family members of the informant are accused and the petitioner is a witness, as such, in the instant case, he has been implicated with an allegation that he torn the clothes of the informant. It is next submitted that specific allegation of firing is against Chintu. It is also submitted that Doma Bind and Chhotaku Bind had approached this Court seeking anticipatory bail by filing Cr. Misc. No.57938/2024 and the same was allowed by an order dated 05.09.2024.
6. Learned A.P.P. for the State Mr. Chandra Bhushan Prasad opposes the prayer for anticipatory bail of the petitioner.
7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.44810 of 2024(4) dt.28-01-2025 3/3 anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bhabua P.S. Case No. 233 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
