JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.

Allegation is that some motorcycle born unknown miscreants snatched the motorcycle of informant and fled away. It has been submitted on behalf of petitioner that he is in custody since 28.5.2015. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is not named in the F.I.R. There is no recovery of any incriminating article from his possession. He has not been put on T.I.P. Other co-accused has been granted bail vide Cr. Misc. no. 41061 of 2015.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

No.54806 of 2016 (2) dt.22-12-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura (Chailadh) P.S. Case no. 675 of 2014.
