1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 137(2), 96 and 87 of the BNS, 2023.

3. Learned counsel for the petitioner submits petitioner is a person with clean antecedent and is a young boy aged about 20 years and the informant alleges that her daughter went missing on 11.02.2026, further alleges that the victim used to talk to the petitioner, it is next alleged that even petitioner went missing since 11.02.2026, hence she went to the house of the petitioner to inquire when his family members abused and threatened.

Learned counsel appearing on behalf of the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that petitioner and victim were known to each other, it is next submitted victim is aged about 17 years and thus had reached the age of discretion. It is next submitted that since both petitioner and the victim went missing on the same day that amply demonstrates that they eloped, it is further submitted that victim came back and her statement was recorded under Section 183 BNSS as recorded in the order impugned, wherein she has not alleged that she was physically exploited rather refused her medical examination even as recorded at Para 16 of the CD, it is next submitted that if petitioner is send to judicial custody his entire career would get jeopardised and chances are bright that he may come in contact with hardened criminal.

5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.

Considering the submissions and taking into consideration the fact that petitioner the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two

Case No. 64 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.

7. One of the bailors of the petitioner shall be his father Anil Mandal.

8. The application stands allowed.
