JUSTICE VIKASH JAIN ORAL ORDER 29-09-2016 As prayed, learned counsel for the petitioner is permitted to make correction in paragraph 24 of the bail petition by correcting the date as "24.03.2015" in place of "24.05.2015".
2. Heard learned counsel for the petitioner and learned APP for the State.
3. The petitioner is in custody since 24.03.2015 in connection with Raghopur P.S. Case No. 30 of 2014 for the offences alleged under Sections 302, 201 and 120B of the Indian Penal Code.
4. It is submitted that the petitioner has been falsely implicated and he is not FIR named accused. The thrust of accusation is against other accused persons and there was also enmity between the informant and another co-accused Munshi Lal Prasad with whose daughter the informant's son was having love affair. The petitioner claims to be the son of said Munshi Lal Prasad and he is not Lalu Prasad, son of Arjun Prasad who is FIR named accused.
5. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten
Patna High Court Cr.Misc. No.41047 of 2016 (2) dt.29-09-2016 2/2 thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Hajipur, Vaishali in connection with Raghopur P.S. Case No. 30 of 2014 with the following conditions:
(i) That one of the bailors shall be a close relative of the petitioner.
(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.
(iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. (Vikash Jain, J) B.T/Ibrar U T
