2. The petitioner has preferred this application for grant of regular bail in connection with Tajpur (Halai O.P.) P.S. Case No. 656 of 2023 dated 06.11.2023 registered for the offences punishable under Section 392 of the Indian Penal Code and 27 of the Arms Act.

3. As per the prosecution case, three unknown miscreants came on motorcycle and entered the office of C.S.P. Thereafter, they looted Rs. 1,50,000/- at the point of gun and fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.38960 of 2025(2) dt.14-08-2025 2/3 this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the FIR but he has been identified through C.C.T.V. footage is vague and unsubstantiated. It is pertinent to mention that the miscreants had covered their faces with masks or gamchhas, making any such identification is highly doubtful. The petitioner has two criminal antecedents in which he is on bail in both cases as stated in para 3 of the bail petition. The petitioner is in custody since 22.02.2025. The co-accused person has already been granted regular bail by this Court vide order dated 31.07.2024 passed in Cr. Misc. No. 47913 of 2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Samastipur in connection with Tajpur (Halai O.P.) P.S. Case No. 656 of 2023, with a condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.38960 of 2025(2) dt.14-08-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be canceled.
