JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

From the shop-cum-godown of Gopal Prasad Agrawal, 800 litres of kerosene oil were seized whereas from Bishu Sao, 50 litres kerosene oil and grains were seized. It is alleged against the petitioner being the kerosene oil hawker, to have supplied alleged kerosene oil to Bishu Sao.

It is submitted by learned counsel for the petitioner that the petitioner is a lady and there is no proof that seized kerosene oil was supplied by this petitioner and admittedly no seizure has been made from the petitioner nor the stock of the petitioner has been verified. A statement has been made in para 3 of the petition

Patna High Court Cr.Misc. No.5403 of 2015 (2) dt.10-02-2015 2/2 that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai in connection with Barahia P.S. Case No. 141 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
