JUSTICE SANJAY KUMAR ORAL ORDER 07-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner, who is in custody since 12.02.2018, seeks bail in connection with Bikramganj P.S. Case No. 39 of 2018 registered for the offences under sections 25(1-b)a, 26 and 35 of the Arms Act.

It has been submitted that out of four apprehended accused, one Chhotu Singh has been allowed bail by one of the coordinate Bench of this Court in Cr. Misc. No. 28101 of 2018. The case of the petitioner stands on similar footing as nothing has been recovered from his possession. The alleged country-made pistol was recovered from the possession of one Vivek Kumar. Considering the nature of allegation, facts and circumstances of the case, the prayer for bail of the petitioner is

Patna High Court Cr.Misc. No.28991 of 2018 (3) dt.07-06-2018 2/2 allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj P.S. Case No. 39 of 2018, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
