The petitioner seeks bail in connection with Birpur P.S. Case No. 101 of 2018 registered for the offence under Sections 467, 468, 471, 420, 120(B) and 34 of the Indian Penal Code.

The accused/petitioner is named in the F.I.R. and is in

Patna High Court CR. MISC. No.41641 of 2022(2) dt.22-10-2022 2/3 custody since 16.03.2022.

The allegation against the petitioner is to obtain employment as Panchayat Teacher on the basis of forged and fabricated document, related to her educational certificate. Learned counsel appearing on behalf of the petitioner submitted that petitioner has been falsely implicated in the present case due to local dispute and differences developed with other staff of the school. It is further submitted that similarly situated co-accused person has already been granted bail by one of the learned Co-ordinate Bench of this Court through Cr. Misc. No. 19375 of 2022 dated 31.08.2022. While concluding the argument, it is submitted that petitioner is a lady of clean antecedent and, moreover, investigation in this case is complete for which chargesheet has been submitted, as such, there is no chance of tampering with the evidence.

Learned APP appearing on behalf of the State opposes the prayer of bail.

In view of the facts and circumstances, as mentioned above, as petitioner is a lady, having no criminal antecedent coupled with the fact that chargesheet has already been submitted, where petitioner is in custody since 16.03.2022, let the petitioner, above named, is directed to be released on bail in

Patna High Court CR. MISC. No.41641 of 2022(2) dt.22-10-2022 3/3 connection with Birpur P.S. Case No. 101 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Begusarai, subject to the conditions as laid down u/s 437(3) of the Cr.P.C. (Chandra Shekhar Jha, J) Ankit/- U T
