2. The petitioners apprehend their arrest in connection with G.B. Nagar P.S. Case No. 118 of 2022 registered for the offences punishable under Sections 447, 147, 341, 323, 325, 307, 379, 354, 504, 506 of the Indian Penal Code.
3. It is alleged that the petitioners along with other coaccused persons armed with sword, rod, lathi-danda abused and assaulted the informant and his family members in which they sustained injuries.
4. It is submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.40701 of 2023(2) dt.01-08-2023 2/2 petitioners have been falsely implicated in the present case with ulterior motive and dirty village politics. It is further stated that there is no allegation of repetition of blow and as such Section 307 of the I.P.C. is not made out. Doctor has found simple injury. Rest of the allegation are super-addition. Petitioners claim clean antecedent.
5. Considering the facts of the case, this pre-arrest bail petition is allowed. In the event of arrest/surrender within six weeks from today, let all the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate3, Siwan, in connection with G.B. Nagar P.S. Case No. 118 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
